Welcome to EasyTag, a product of Digital Sign Technologies Inc. (“EasyTag,” “we,” “us,” or “our”). These Terms and Conditions ("Terms of Use") govern your use of our website and services (collectively, the "Services"). By using EasyTag, you agree to comply with these Terms. If you do not agree with these Terms, please refrain from using our Services.
1. Acceptance of Terms
By accessing or using EasyTag’s Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our Services.
2. Changes to Terms
We reserve the right to modify or update these Terms at any time. It is your responsibility to review these Terms regularly. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
3. Account Registration and Eligibility
EasyTag accounts are available to users who are at least 16 years old or the age of majority in their jurisdiction. By creating an account, you represent that you are using EasyTag for either personal or business purposes. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Software Ownership and License
EasyTag is proprietary software owned by Digital Sign Technologies Inc. You are granted a limited, non-exclusive, non-transferable right to use EasyTag in accordance with these Terms. You may not copy, modify, distribute, or reverse-engineer the software without express permission.
5. Service Plans and Pricing
EasyTag offers flexible plans that scale with your needs. For detailed pricing information, please refer to the Pricing page on our website. All prices are in USD and are subject to applicable taxes. We reserve the right to modify pricing at any time and will notify users at least 30 days before any price changes take effect. You may cancel your subscription if you do not agree to the new pricing.
6. Billing and Payment
You must provide accurate billing information, including credit card details or any other payment method you choose. Service fees will be automatically charged to the payment method on file. Failure to provide timely payments may result in the suspension or termination of your account.
7. Free Trial Offers
Users participating in free trials will not incur service fees during the trial period.
8. Account Cancellation/Termination
You may cancel your account at any time. Depending on your plan, refunds may or may not be issued. We reserve the right to terminate accounts for non-payment, inactivity, violation of these Terms, or at our discretion, without explanation.
9. Data Usage and Privacy
By using EasyTag, you consent to the collection and use of your data as outlined in our Privacy Policy. We may share anonymized data with third parties for analytical purposes. Your personal data will be protected under applicable data protection laws.
10. Content Ownership and License
We do not claim ownership of the content (e.g., images, documents, or any other information) you upload through EasyTag. However, by uploading content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and modify the content for operational purposes. This license will terminate when the content is deleted from EasyTag.
11. Prohibited Content and Account Termination
EasyTag users are prohibited from uploading or sharing inappropriate, offensive, or illegal content, including but not limited to, content that is defamatory, discriminatory, obscene, or violates any laws. We reserve the right to monitor uploaded content and remove anything we deem inappropriate or in violation of our Terms. We may terminate or suspend user accounts without notice if such content is detected or reported.
12. Picture Usage and Visual Documentation
EasyTag allows users to document shipments through photos at every step of the process. You are strictly prohibited from uploading or sharing inappropriate, offensive, or harmful images. If such content is detected, EasyTag reserves the right to remove it and cancel your account without notice.
13. Use of the Site and Service
EasyTag may not be used for any illegal or unauthorized purposes. You must comply with all applicable laws and regulations regarding the use of the service, including international export and import rules, as well as privacy regulations.
14. User Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. EasyTag will not be held liable for any unauthorized access resulting from a failure to safeguard account information.
15. Disclaimer of Warranties
EasyTag is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or secure. You use EasyTag at your own risk, and we disclaim all warranties regarding the functionality, reliability, or availability of our Services.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Digital Sign Technologies Inc. and its affiliates, directors, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Services by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Digital Sign Technologies Inc. has been advised of the possibility of such damages.
In no event shall Digital Sign Technologies Inc.'s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing or using the Services during the three (3) months preceding the event giving rise to liability, or one hundred U.S. dollars (USD $100), whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.
17. Age Restriction
You must be at least 16 years old to use EasyTag. By accessing or using EasyTag, you represent that you meet this age requirement. While EasyTag is suitable for both businesses and individuals, it is primarily designed for business use. Users under 16 are not permitted to use the platform, and any accounts found in violation of this restriction may be terminated without notice.
18. Dispute Resolution
These Terms will be governed by the laws of Ontario, Canada. Any disputes arising from these Terms or your use of EasyTag will be resolved exclusively in the courts of Ontario, Canada. By using EasyTag, you agree to submit to the jurisdiction of these courts.
19. Intellectual Property and License
We retain all rights to the software and intellectual property made available through EasyTag. You are not permitted to copy, modify, or distribute any part of EasyTag’s software or Services without our explicit written consent.
20. Feedback
By submitting feedback or suggestions, you grant us the right to use them without any obligation to compensate you.
21. Data Sharing and Privacy
By using EasyTag, you agree to our collection, use, and sharing of your data as outlined in our Privacy Policy. We may share anonymized data with third parties, including law enforcement, to ensure the security of our platform.
22. Modifications to the Service
We reserve the right to modify or discontinue any part of EasyTag at any time without notice.
